Federal Judge Strikes Down New York's Ban on Civilian Body Armor Sales

WESTERN NEW YORK — A federal judge in western New York has struck down New York's ban on the sale and purchase of bulletproof vests by civilians, ruling it unconstitutional. U.S. District Judge John L. Sinatra Jr. issued the 47-page decision Wednesday, finding that body armor is protected under the Second Amendment and that the state failed to show a historical justification for its restrictions.

The judge granted a permanent injunction against the challenged provisions — but stayed the order for 14 days to allow the state to appeal, so the ban remains enforceable for now.

New York is the only state that prohibits civilian purchase of body armor outside a list of authorized professions. The 2022 law was part of a legislative package passed after the May 2022 mass shooting at a Buffalo supermarket that killed 10 people.
